  1. Introduction
    Welcome to EJA Electrical & Air ("we," "our," or "us"). These Terms and Conditions ("Terms") govern the provision of electrical contracting services provided by us. By engaging our services, you ("Client" or "you") agree to these Terms.

  2. Services
    We offer electrical contracting services, including but not limited to installations, repairs, and maintenance of electrical systems ("Services"). The scope of the Services will be detailed in a separate proposal or contract.

  3. Agreement
    A formal agreement will be established through a written contract or service order outlining the specific Services to be performed, associated costs, and any other pertinent details. These Terms form part of that agreement.

  4. Payment Terms

  • Fees: Fees for our Services will be specified in the contract or service order. Additional charges may apply for unforeseen issues or changes in the scope of work.

  • Invoices: Invoices will be issued upon completion of the Services or at specified intervals as agreed. Payment is due on the date of the invoice unless otherwise agreed.

  • Late Payments: Late payments will incur a 1% late fee per month or part thereof, calculated on the outstanding amount.

  1. Client Responsibilities

  • Access: The Client must provide timely access to the site and ensure it is safe for our personnel to perform the Services.

  • Information: The Client must provide accurate and complete information related to the project, including any pre-existing conditions or constraints.

  • Permits: The Client is responsible for obtaining and paying for any necessary permits or approvals required for the Services.

  1. Changes and Cancellations

  • Changes: Any changes to the scope of work must be agreed upon in writing. Changes may affect the project timeline and cost.

  • Cancellations: If the Client cancels the contract after work has commenced, the Client will be liable for payment of work completed up to the cancellation date and any additional costs incurred.

  1. Warranty
    We warrant that the Services will be performed in a professional and workmanlike manner. This warranty does not cover issues arising from misuse, neglect, or modifications made by the Client or third parties.

  2. Liability

  • Limitations: Our liability for any claims arising from our Services is limited to the amount paid for the specific Services giving rise to the claim. We are not liable for any indirect, incidental, or consequential damages.

  • Insurance: We maintain appropriate insurance coverage for our Services. Details are available upon request.

  1. Confidentiality
    Both parties agree to keep confidential any proprietary or sensitive information obtained during the course of the Services and to use such information solely for the purpose of performing the Services.

  2. Termination
    Either party may terminate the agreement with written notice if the other party breaches a material term of the agreement and fails to rectify the breach within a reasonable period.

  3. Dispute Resolution
    Any disputes arising under these Terms will be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute will be submitted to binding arbitration in accordance with the rules of QCAT in Queensland.

  4. Governing Law
    These Terms and any agreement with the Client will be governed by and construed in accordance with the laws of Queensland, Australia.

  5. Severability
    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

  6. Amendments
    We reserve the right to amend these Terms at any time. Changes will be effective upon posting on our website or otherwise communicated to the Client.
